Scope of work

  • Divorce by mutual consent
  • Contested divorce
  • Regulation of parental responsibilities
  • Child and spousal support
  • Prenuptial agreements
  • De facto unions and asset matters

Regulation of parental responsibilities

The regulation of parental responsibilities defines the child's residence, contact arrangements and child support, as well as whether decisions on matters of particular importance are exercised jointly or by one parent. It may result from an agreement between the parents — subject to an opinion from the Public Prosecutor and approved by the civil registrar or the court, depending on the procedure followed — or from a court decision where no agreement is reached. Supervening changes (country, income, the child's needs) justify amending the regime. We frequently work with parents living abroad, including in cases with international elements. Divorce by mutual consent

Where there is agreement on the divorce and on the connected matters, the process runs at the Civil Registry Office and is typically fast. We prepare the required agreements — parental responsibilities, family home, maintenance and the detailed list of common assets or an agreement on their division — and handle the scheduling and the conference. How we work

The responsible partner reads the entire matter before the first reply. Timeline and fee estimates are communicated in writing at the outset and updated whenever there is a relevant development. We are bound by the Statute of the Portuguese Bar Association (Law 145/2015) and by Law no. 6/2024 on legal advertising: we do not promise outcomes or compare ourselves with other firms.

Frequently asked

It is the regime that defines, for minor children, residence, contact with each parent and child support, as well as the matters of particular importance in the child's life. It can result from an agreement approved through the applicable civil registry or court procedure, or from a court decision, and can be amended when circumstances change.
Where the spouses agree on the divorce and on the connected matters (parental responsibilities, family home, maintenance and the detailed list of common assets or an agreement on their division), the process runs at the Civil Registry Office and is typically fast. Without agreement, the divorce proceeds in court.
Generally no. Portuguese court proceedings run electronically (Citius) and most steps can be prepared and followed remotely; we represent clients across the country and abroad from Porto and Lisbon.
